These Terms and Conditions ("Terms") govern your use of Buukable ("we", "us", "our") and the services we provide. By creating an account or using Buukable, you agree to these Terms. If you do not agree, you must not use the service.
1. Our service
Buukable is an online appointment scheduling and business management platform. We provide tools to manage bookings, calendars, clients, services and related communication. We may modify, add or remove features from time to time.
2. Eligibility
To use Buukable, you must be at least 18 years old and have the authority to enter into agreements on behalf of yourself or your business. By using the service, you confirm that you meet these requirements.
3. Your account
You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. You agree to:
- Provide accurate and up-to-date information
- Keep your login credentials secure
- Notify us promptly of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms, are used for unlawful purposes or compromise the security or stability of the service.
4. Subscription, billing and payments
Buukable may offer free and paid plans. Pricing and features for each plan are described within the product or on our website.
For paid plans, you authorize us or our payment processor to charge your chosen payment method. Subscriptions typically renew automatically at the end of each billing period unless you cancel before the renewal date.
Unless required by law or explicitly stated otherwise, fees are non-refundable. You can cancel your subscription at any time; the cancellation will take effect at the end of the current billing period.
5. Acceptable use
You agree that you will not:
- Use the service for unlawful, harmful or fraudulent purposes
- Attempt to access accounts or data of other users without permission
- Interfere with the proper functioning of the service
- Reverse-engineer, decompile or copy the service
- Use the service to send spam or unsolicited messages
6. Your content
You retain ownership of the content you upload or create in Buukable (for example customer lists, bookings, business details). You grant us a limited, non-exclusive, worldwide license to store, process and back up this content as needed to provide and improve the service.
You are responsible for ensuring that your content and use of the service comply with applicable laws and that you have all necessary rights to such content.
7. Data protection and privacy
Our processing of personal data is described in our Privacy Policy and Cookies Policy, which form part of these Terms. By using Buukable, you agree to the processing of your data as described in those policies.
8. Service availability and changes
We aim to keep the service reliable and available, but we do not guarantee uninterrupted or error-free operation. We may temporarily suspend or limit access for maintenance, updates, security or other operational reasons.
We may change or discontinue features or parts of the service at any time. Where appropriate, we will try to provide reasonable notice.
9. Third-party services
Buukable may integrate with third-party services such as payment processors, analytics tools or communication providers. We are not responsible for the content, policies or practices of those third-party services. Your use of them is subject to their own terms and conditions.
10. Intellectual property
The Buukable platform, including its design, software, logos and trademarks, is owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the service in accordance with these Terms.
You may not copy, modify, distribute or create derivative works based on the service, nor use our trademarks without prior written consent.
11. Disclaimer of warranties
Buukable is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or business opportunities.
Our total liability for any claim related to the service is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or zero for free users.
13. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, losses or costs arising from your use of the service, your violation of these Terms or your infringement of any third-party rights.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. If changes are significant, we may notify you by email or through the platform. Your continued use of Buukable after changes become effective constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws applicable in the jurisdiction where Buukable is legally established, unless otherwise required by mandatory local law. Any disputes arising from or relating to these Terms will be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
